These Terms of Service govern your use of Feedback Notes, a performance feedback documentation tool ("we", "us", "our"). By creating an account or using the service, you agree to these terms.

1. Description of Service

Feedback Notes is a tool that uses AI (provided by Anthropic or OpenAI, using your own API key) to assist with drafting performance feedback documentation. It is intended strictly for personal use — meaning use by the individual account holder, acting on their own initiative and at their own discretion.

Generated notes are documentary in nature and do not constitute formal performance ratings or official assessments of any kind.

2. Personal Use and User Responsibility

You are solely responsible for any information you submit to this service. Before submitting any narrative or details about another individual, you must satisfy yourself that doing so is appropriate, authorized, and consistent with your obligations under applicable privacy law and any applicable information security requirements.

We make no representation that submitting information about other individuals through a third-party AI service is permitted under your organization's policies or applicable law. We expressly disclaim any liability arising from your decision to submit such information. If you are uncertain whether it is appropriate to use this tool in a given context, do not use it.

You must be at least 18 years old to use this service. By registering, you confirm that you accept these terms and take full responsibility for your use of the service.

3. Access and API Keys

Feedback Notes is provided free of charge. To generate notes, you must supply your own API key from a supported AI provider (Anthropic or OpenAI). You are solely responsible for any costs charged to you by your AI provider in connection with your use of this service.

Your API key is encrypted before it is stored and is used only to process your requests. We do not charge you for use of this service and do not handle any payment information.

4. Acceptable Use

You agree to use Feedback Notes only for personal, individual use in drafting performance feedback documentation. You must not:

• Share your account credentials with others or use the service on behalf of another person
• Submit protected, classified, sensitive, or privacy-protected information about any individual
• Use the service in any way that violates applicable privacy legislation or your duty of confidentiality
• Attempt to reverse-engineer, scrape, or abuse the service
• Use the service for any unlawful purpose

5. AI-Generated Content

Notes are generated using AI (Anthropic Claude or OpenAI GPT-4o, via your own API key). Generated notes are documentary in nature and do not constitute formal performance ratings or official assessments. You are responsible for reviewing and verifying any generated content before use. We make no warranty as to the accuracy, completeness, or fitness for purpose of AI-generated output.

6. Data and Privacy

Your narrative input is sent to Anthropic's Claude API to generate notes and is not stored by us. Only your account information and monthly usage count are retained. Please review our Privacy Policy for full details.

7. Intellectual Property

The Feedback Notes platform, design, and software are our property. You retain any rights to the content you input and the notes generated for you.

8. Limitation of Liability

To the fullest extent permitted by law, Feedback Notes and its operators are not liable for any indirect, incidental, or consequential damages arising from your use of the service, including reliance on AI-generated content.

9. Termination

We may suspend or terminate your account if you violate these terms. You may close your account at any time by cancelling your subscription and contacting us.

10. Changes to These Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the revised terms.
